Nolah Technologies, LLC (“Nolah Technologies”, “we” or “us”) has established this privacy policy to explain to you how your information is protected, collected, and used on its website, nolahmattress.com (the “Site”). We may update this policy at any time. We will provide notice of materially significant changes to this privacy policy by posting notice on the Site.

We make all attempts to protect your private information. We will not share your personal information with any third parties without your consent unless otherwise specified in this Policy.

We, or people who post on the Site, may provide links to third party websites, which may have different privacy practices. We are not responsible for, and do not have any control over, the privacy policies of those third party websites, and encourage all users to read the privacy policies of each and every website visited.

SECTION 1 - WHAT INFORMATION DO WE COLLECT?

We may collect your name, email address, physical address, and phone number for shipping purposes if you purchase items from us.

We sometimes collect your email address, for purposes such as sending email newsletters, product release information, sale information, and authenticating your account. By submitting your email to us, you consent to emails from us regarding your purchase. You may further authorize us to send you general email messages.

We may collect personal information if you provide such information in feedback or comments or if you contact us directly. Any information posted on the site is not confidential. Please do not post anything on the Site that you would like to keep private.

The Site’s weblogs collect standard weblog entries for each page served, including your IP address, page URL, and timestamp. Weblogs help us diagnose problems with our server, to administer the Site, and to otherwise provide service to you. In addition, we may collect other information from your interaction with our Website, services, content, and advertising, including computer and connection information, statistics on page views, traffic to and from the Website, ad data, IP address, demographic and navigational data, and standard weblog information. This information may be obtained for us from a third party provider including, but not limited to, through the use of Google Analytics and Shopify.com. We may use this information for marketing, commercial, or any other purpose as we see fit.

We do not knowingly collect any information from persons under 13 years of age, although we do collect information about individuals under 13 if provided by you. Further, the use of the Site and/or buying any items from the Site is only knowingly allowed by individuals who are over the age of 18 and can enter into legally binding contracts.

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we infer that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

We may disclose information about its users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process.

We may disclose information about its users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to claims that any posting or other content violates the rights of third-parties; or protect the rights, property, or personal safety of the third-party, its users, or the general public.

We may disclose your information to third parties for use by us. This may include disclosure to email marketing providers to provide targeted marketing for our users. If you do not wish to receive email marketing from us, you will have the option to unsubscribe from the service.

We may disclose your information to other business entities, should we plan to merge with or be acquired by that business entity.

We may disclose your information in the event that you dispute any charges incurred by you with Shopify.com and/or any other third party service provider from us.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

Here is a list of cookies that we use. We’ve listed them here so you can choose if you want to opt-out of cookies or not.

_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

_secure_session_id, unique token, sessional

storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - ARCHIVING

Search engines and other sites not affiliated with us may archive or otherwise make available our individual webpages. We have no control over third party archiving and search engine sites and cannot guarantee the accuracy of any information stored by search engine sites.

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

SECTION 10 – DATA STORAGE

All information posted to our Site may be stored in the Site’s database, even after "deletion”, and may be archived elsewhere.

Our Site’s weblogs and other records are stored indefinitely. This may include any information you supply to us, your purchase history, and your browsing history. However, we cannot guarantee access to these records by third parties for more than three business days after the original information was submitted.

Although we make good faith efforts to store the information in a secure operating environment that is not available to the public, we cannot guarantee complete security.

We may store information in an off-site location, which may or may not be located in the United States and may not be bound by the laws of the United States.

SECTION 11 - GEOTRACKING

We do not do any geotracking at this time through our systems; however, certain third party providers, such as Google Analytics and/or Shopify.com, may request this information if your device allows it.

SECTION 12 - CCPA (California Consumer Privacy Act)

Under California Civil Code Section 1789.3, if you are a California resident, you have the right to request Nolah Technologies, LLC provide access to information, request that it be corrected, updated or erased and request information about how Nolah Technologies, LLC discloses your information to third parties for a business purpose. Please note Nolah Technologies, LLC does not sell personal information. Please refer to the Privacy Policy above, for details on information collected and third parties with whom information is shared such as cookies and other tracking tools used to analyze website traffic and facilitate advertising.

SECTION 13 - INTERNATIONAL USERS

We welcome international users to browse the Site. International Website Users consent to all the terms of service and this privacy agreement. International users waive any and all remedies that they may have based on the laws of their country.
